Abstract

On 23 October 2019 the European Parliament and the Council adopted Directive (EU) 2019/1937, a piece of secondary legislation encompassing the first organic regime concerning whistleblowing to have been elaborated at supranational level, that Member States will be required to transpose by 17 December 2021. This paper aims to clarify the directive’s impact on the Italian legal framework, which is currently defined by Law 179/2017, as well as the opportunities to be taken on the occasion of the directive’s implementation. By means of a comparison between these two regimes, both their different ways of conceiving whistleblowing and the respective implications for the domestic legislator are highlighted. This will require the same legislator to adopt a radical change of perspective. As far as the national level is concerned, the analysis will focus on provisions affecting the Public Administration.
