Abstract
Starting from the regulatory data enshrined in the Pisanelli code of 1865 and analyzing the reflections carried out on the point by Italian doctrine at the turn of the 19th and 20th centuries, the contribution, also thanks to the rich documentation kept in the private archive of the jurist Filippo Vassalli, intends to analyze the results of the preparatory work undertaken by the Royal Commission for the reform of the codes and thus retrace the main steps that have led to the current discipline on the subject of state property and public property.
