Abstract

[Autom. eng. transl.] The contribution is dedicated to the social dangerousness, a dogmatic-penal and empirical social category that is going through a phase of particular expansion. The developments of modern criminal politics seem to suggest different paths depending on whether the social danger - understood as the probability of repeating offenses - concerns generic cases of individual danger, or specific forms of danger (those of the subject attributable to a mental disorder, or not attributable to mental infirmity). Particular relevance is attributed to the contribution offered by neuroscientific studies on the prevention of recidivism, in the light of a dynamic model of interpretation of the brain which, in terms of response to the crime, induces to privilege a more human and empathic approach towards the delinquent.
