Abstract

[Autom. eng. transl.] The work examined the evolution of the constitutional process in the twenty years following 1990, that is after the "turning point" constituted by the disposal of the backlog by the Constitutional Court. Particular attention was paid to the jurisprudence relating to those institutions that characterize the incidental judgment, such as relevance, conformal interpretation, but also to the types of decisions. In the work it was considered that the provisions of art. 111 of the Constitution on the "fair trial" were also applicable to the trial before the Constitutional Court, in light of the jurisdictional nature assumed by the Court itself, and the consequences were verified from the point of view of the legal reserve, but also of the adversarial and equality of weapons.
