Abstract

The essay deals with the application of artt. 13 and 18 of Workers’ Statute after 40 years in force. The most important orientations of the Employment Courts are examined, as well as the most significant legislative modification adopted also in contiguous fields. In the author’s opinion the jurisprudential and legislative evolution has brought about a fairly reasonable mix of protection and flexibility; the opinion is confirmed by a quick comparison with the experience of some European countries. In conclusion, the author suggests that the policy makers proceed cautiously in reforming these and other crucial articles of the Workers’ Statute.
