Abstract

[Autom. eng. transl.] The volume presents the results of a research aimed at reconstructing the interpretation of some of the most important United Nations human rights protection bodies regarding cultural rights. On the occasion of the elaboration of the right to participate in cultural life, sanctioned by the Universal Declaration of Human Rights and the subsequent International Pact for economic, social and cultural rights, reference was made to a 'materialistic' conception of culture, according to which this would be attributable exclusively to the noblest and highest expressions of man's artistic and intellectual activity (art, literature, music). Faced with this limited definition, the legal doctrine has developed an intense reflection coming to elaborate a particularly extensive notion of cultural rights that is based on an 'anthropological' concept, according to which culture covers all the activities that characterize the way of life of a person or a group and that are strictly connected to their identity. Through an analysis of the practice of some of the United Nations' human rights protection bodies, the text seeks to highlight that, on the basis of doctrinal reflection, these bodies - and in particular the Committee for economic, social and cultural rights - are come to accept an anthropological notion of culture and to interpret cultural rights as the set of rights that allow the person to build and express their identity and, therefore, to recognize themselves and be recognized in their dignity.
