Abstract
[Autom. eng. transl.] The first part of the contribution aims to examine the main profiles of the case of road homicide, highlighting the frictions with respect to some institutions of the general theory of crime and the regulation of accidental elements and the concurrence of crimes. In the second part, starting from the analysis of foreign legislation, the proposal will be developed for an alternative model for the prevention of road crime, gradual and diversified, which promotes, as a first objective, the empowerment of users. In this perspective, by evaluating the protection schemes focused on the negative value of action, it will reflect on the opportunity to intervene on the administrative offenses of the Highway Code and to introduce, at intermediate level, offenses of concrete danger for the safety of people. who know how to intercept serious and voluntary violations of road traffic rules.
