Abstract

[Autom. eng. transl.] Starting from the failure in the prevention of the Covid-19 pandemic, the contribution highlights a series of counterproductive effects of the current intervention criteria of the criminal law against the commission of crimes by formulating a series of proposals for reform, according to the following index: 1. Prevention, this unknown. - 2. If the behavioral precept is made adept and elusive. - 3. The conspiracy of silence correlated (but not only) to the model of culpable crime. - 4. Yet nothing new: punish one to educate a hundred. - 5. Some instructions must also be drawn from the story relating to the abuse of office. - 6. The mother of all magic formulas: prevention through retribution. - 7. The response to the crime as a project: despite everything, an idea that is gaining ground. - 8. Different sanctions, but conceived in a single way. - 9. The apotheosis of the trial is not condemnation: it is a matter of truth, to improve. - 10. The offense is irrevocable, but the open fracture of the offense does not heal on the scales. - 11. On the methods intended to concretely determine penal sanctions that are no longer retaliatory. - 12. It is urgent to overcome the dynamics of conflict in the world: a cultural role to be taken up, and a bell that rings, even for the criminal lawyer.
