Abstract

[Autom. eng. transl.] In the ruling noted, the European Court of Human Rights held that in Italy, as a result of art. 69 l. 18 June 2009 n. 69 and art. 48 cod. proc. amm., the extraordinary appeal to the President of the Republic has been judged; therefore, starting from 16 September 2010, the date of entry into force of the administrative process code, art. 6, par. 1, of the EDU convention on the right to a fair trial within a reasonable time. The comment critically examines the arguments in favor of this orientation and highlights the possible repercussions of this interpretation also with respect to other profiles.
