Abstract

[Autom. eng. transl.] The European Convention on Human Rights and the jurisprudence of the Court of Strasbourg are today increasingly perceived as an integral part of the right that the Italian criminal court is called to interpret and apply on a daily basis, in its capacity as "first guarantor" of conventional rights. From the point of view of the lawyer, on the other hand, the prospect of an appeal to Strasbourg always remains in the background of the possible defensive options to safeguard fundamental rights, once the internal remedies are exhausted; but, much earlier, the European Convention on Human Rights and its interpretation can today prove to be valuable tools during the criminal trial, to solicit the overcoming of consolidated interpretative practices and / or the formulation of questions of constitutional legitimacy. This volume systematically illustrates the jurisprudence of the Court of Strasbourg concerning the relevant conventional provisions in the criminal trial and intends to constitute a sort of vademecum for the Italian magistrate, lawyer and scholar, who wish to compete with the necessary rigor with by now numerous questions that call into question the sphere of protection of human rights.
