Abstract
[Autom. eng. transl.] The essay deals with the comparison between the thought of Piero Calamandrei, concerning the powers of the civil judge, and that of the major proceduralists of the beginning of the century, both Italian and German speaking; all analyzed from the perspective of the general evolutionary profiles of the modern civil process.
