Controlli societari e responsabilità penale

[Autom. eng. transl.] The volume analyzes the issue of the responsibility of the control bodies of commercial companies for the criminal offenses committed by the company's top management. After a comparison with the organizational dynamics of the white collar crime as well as with the criminological constants that characterize the crimes committed within the companies, the work is critically compared with the most recent jurisprudence in an attempt to recover the fundamental constitutional principles of legality and guilt in assigning responsibilities within the company. Furthermore, from a political-criminal point of view, possible alternative models of prevention of financial scandals are analyzed, often originating from a systematic failure of internal and external controls to companies.
