Abstract
[Autom. eng. transl.] The contribution analyzes and comments on the provision of the d. lgs. n. 231 of 2001 which asks the criminal judge to ascertain the liability deriving from an administrative offense. In particular, the comment identifies the underlying rationale of this provision, the competent criminal judge, the rules applicable to the judge in the proceedings against the institutions, the implications of the exclusive jurisdiction reserved in this matter for the criminal judge
