Abstract

[Autom. eng. transl.] The pronunciation under review addresses the issue of possible interferences deriving from the preparation of an adjustment clause of the original price with the exception of non-fulfillment pursuant to art. 1460 of the Italian Civil Code. In particular, the Author describes as generic style clauses within the Italian legal system all the generic renegotiation clauses that give the parties only a mere faculty to renegotiate the initial agreement without imposing a real obligation on them to negotiate for the modification of the original contractual conditions in the presence of circumstances arising during the execution of the relationship.
