Cibo, religione e diritto

[Autom. eng. transl.] The essay deals with the relationship between food, religion and legal systems. Outlined the principles based on the main regulatory complexes of Religious Food Rules (RAR) and analyzed the impact of these within their respective confessional systems, the paper focuses on the impact of the RAR in the civil legal systems and in particular the possibility of configuration of a subjective right of religious food freedom understood as the right to adapt one's diet to the religious prescriptions on the subject. There are two possible variations of this right. The negative one with the problems of balancing interests that are sometimes in conflict: those, for example, with animal welfare or more stringent ones deriving from possible conflict dynamics within the family. Then the positive one that takes into consideration the obligations of the State to guarantee, for example, spiritual food assistance in closed institutions (hospitals, penitentials, barracks) and in those that can be assimilated (schools, companies, etc.). Finally, the essay deals with the economic significance of religiously compliant food production and the issue of religious food certifications.
