Abstract

[Autom. eng. transl.] 1. Introduction. - 2. Nature and object of the art. 16 of the Prelaws. - 3. The erosion of the application scope of the art. 16 of the Prelaws: (a) Reciprocity and fundamental rights; (b) Reciprocity and international investment protection; (c) Reciprocity and European integration; (d) Reciprocity and immigration legislation; (e) Reciprocity and international unification of conflict of law rules. - 4. Problems raised by the residual applicability of the art. 16 of the Prelaws: (a) The ineffectiveness of the reciprocity condition; (b) The inefficiency of the reciprocity condition; (c) The condition of reciprocity as a factor of uncertainty. - 5. Conclusions.
