Abstract
The paper examines the main problematic profiles that have emerged in the debate regarding the introduction of the majority clause in decisions to amend the social contract of partnerships. It outlines the discussion from the most ancient positions which advocate for limitations on the applicability of the clause, to more recent ones, which argue that such clause should be associated with a decisional procedure that ensures the involvement of all the partners.
