Abstract

[Autom. eng. transl.] The biobank as a collection of human biological materials offers medical research a number up to a few years ago of homogeneous finds for certain characteristics and information that can be inferred from them. Sometimes, think of the banks of cord blood, it also offers elements that can be used in the therapeutic field. Therefore, it is a resource characterized by a particular solidaristic finalization. But what it makes available is extraordinarily delicate: because it could be used for the most different purposes; because it is able to provide sensitive knowledge about the health of the donor and his relatives; because it could arouse interest from points of view that are completely different from healthcare. Human biological elements are an expression of an individual's identity and carry their characters. Everyone, therefore, has the right and duty to supervise their use, giving their consent on the basis of an adequate identification of the present and future research area (or management for therapeutic purposes) to which they are destined or excluding types of use deemed unacceptable. This responsibility does not fail only because it makes the relationship between a certain biological material and the individual from which it originates unrecognizable, through anonymisation procedures. That relationship, moreover, must be able to be reconstructed for the purpose of communicating data that have a medical interest (to be carried out always through a serious medical and psychological counseling). Awareness raising to donate biological materials is thus intertwined with the need for these to be managed in a transparent and scientifically qualified manner, as well as with the need for constant dialogue between donors and their families, the research community and all potential beneficiaries of the activities carried out in a biobank. The volume, therefore, collects interventions that come from different skills (biology, medicine, philosophy, law, bioethics), aimed at highlighting problematic issues and formulating proposals for ethical and legal regulation.
