Abstract

[Autom. eng. transl.] THERE. is inspired by the sentence in question, concerning a special report published on "The Economist" concerning Italian history (which stated that Silvio Berlusconi's victory in the 2001 general elections would have represented "something not good for the country at light of investigations and judicial measures in progress "), to address the issue of the right to report and honor / reputation. In particular, the Author continues, the investigation conducted by "The Economist" is not considered by the Milanese Court as defamatory, as instead indicated by Berlusconi himself. The Judge on the merits, concludes the A., Affirms that the concrete expression of the constitutional right of criticism, the son of freedom of expression and of the press, was not only conformed to the general criterion of continence, but was also based on a plan of absolute consistency with the same facts that only a few years later were judged unfit to integrate penalistically relevant cases.
