Abstract
[Autom. eng. transl.] New reflection on the powers of confiscation (commissum) and seizure (pignoris capio) of the publicans towards the taxpayers attested by the Lex portus Asiae or Monumentum Ephesenum, with particular attention to the technical meaning of the term ἀγωγή, which in the text appears in two additions (§§ 37 and 38 of 72 BC) in connection with ἐνεχύρου λῆψις, that is pignoris capio (ἀγωγὴ καὶ ἐνεχύρου λῆψις) and once individually (§ 57 of 8 or 14 AD). Understanding the meaning of this term is of crucial importance for understanding the means of protection of the publicans against defaulting taxpayers, but its generic nature has made it particularly difficult to reconstruct the Latin original. The fact that the translator of the lex proves in many cases to be so faithful to the Latin original as to sacrifice the clarity of the Greek text, makes this task even more difficult.
