Abstract

[Autom. eng. transl.] The note relates to the sentence of the Council of State, section VI, 27 April 2021, n. 3385, on the subject of validating the defect in the motivation pending judgment. The interest of the decision is recognized in the "procedural" enhancement of the powers of review with a conservative outcome as functional to reconciling the appeal structure of the judgment and the need for a "re-rating" of the motivational obligation with the aspiration to a more complete and, consequently, definitive judicial assessment with respect to the substance of the dispute, also in relation to the recently introduced foreclosure mechanisms. However, the corresponding devaluation on a "substantial" level, far below the possibilities offered by positive law, is criticized.
