Abstract
[Autom. eng. transl.] The comment analyzes the codicistic discipline of the relationship of causality, examining in detail the doctrinal and jurisprudential debate on the subject. Particular attention is devoted to the model of subsumption under scientific laws and to the profile of the concretization of the law of coverage in the individual case. The discipline on the issue of omission causality is then analyzed, focusing in detail on the structural identity with respect to the commission causality and on the different legal assessment paths. Finally, the contribution examines the articulated system of guarantee positions obtainable starting from art. 40 para. cp
