Abstract
[Autom. eng. transl.] The comment critically examines the main interpretative guidelines of doctrine and jurisprudence formed in relation to art. 100 Code of Civil Procedure, highlighting how this is a key provision to understand the structure of the civil trial and, in particular, of the subjective positions, active and passive, recognized by the law in this field.
