Abstract

[Autom. eng. transl.] The volume collects numerous writings, dedicated both to traditional themes of criminal procedure, but studied according to new profiles, as well as to topics arising from contemporary (not only legal) experience. Thus, the probative phenomenon is examined in an epistemological perspective and in relation to the contributions offered for the reconstruction of the facts from the technical-scientific discoveries, without ignoring the transnational evidential circulation; while, for example, the problems of the relations between quaestio facti and quaestio iuris or between the prescription of the crime and the prescription of the action are addressed, and a conceptual arrangement is proposed oriented towards applicative solutions that safeguard human rights for that new procedural frontier constituted from the use of artificial intelligence in the judiciary.
