Abstract

[Autom. eng. transl.] The obligation for Italy to adapt to the precepts of the European Convention of Human Rights in accordance with the interpretation of the Strasbourg Court is not the effect of a theoretical construction, but the provision of a normative apparatus. Also the margin of appreciation recognized to the States adhering to the same Convention for the implementation of the aforementioned agreement is subject to the control of the European Court, which can verify that the exegetical limits identified as legitimate are not exceeded.
