Abstract

[Autom. eng. transl.] The contribution, recalling the essential features of the genesis and contents of the Youth Guarantee, intends first of all to draw attention to the profiles of interest that the study of a European program like this highlights from the point of view of constitutional law. The review of these profiles will be brief, then focusing the analysis on the changes just mentioned. With it, however, we propose to point out the multiple solicitations that the observation of the program addresses to typically constitutionalistic themes and perspectives of investigation, as well as to propose to scientific reflection a threefold opportunity that sector research could seize by applying to an object of study, such as Youth Guarantee, hitherto left to other disciplinary paths: the better understanding of the multilevel policy mechanisms concerning areas of competence in which the European Union is only entitled to support and coordinate national policies and in which, however, as in the case labor and welfare, many Member States are in trouble; the opportunity to test the constitutional project the conception, emerging from the European program, of public intervention on the two great transition processes of personal life (from youth to adult life, from school to work) that Youth Guarantee intertwines and would like to address with the same tools (and vice versa, since these transition processes take place in a social context that has profoundly changed from that of the constitutional project and in turn put it to the test); the opportunity to enrich, from a methodological point of view, the toolbox of constitutional investigation, which in an area like this must necessarily have an intense dialogue with different perspectives of analysis of legal research and social research. Having said that, the main objective of the work is to focus on the changes that in the sector of labor and youth policies have been triggered by the European program, focusing on those that have involved cooperation between state and regional administrations, without neglecting (at least for the food for thought that they arouse) some changes in the relationship of administrations with private providers of employment services and with the third sector.
