Abstract

[Autom. eng. transl.] The essay illustrates the discipline of all the categories of stock market rigging provided for in the Italian criminal law, starting from those contained in the penal code (articles 501 and 501bis of the Criminal Code) to arrive at those contained in other regulatory bodies (article 2637 of the civil code; art. 185 ss. TUF). Besides the analysis of the objective and subjective elements of these hypotheses of crime, carried out in the light of the main doctrinal and jurisprudential orientations on the subject, the essay deals with the issue of the complex relationships between the criminal case of market manipulation and the corresponding administrative offense, which have raised many interpretative problems in the aftermath of the legislative reform made with the Legislative Decree n. 62/2005.
