Abstract
[Autom. eng. transl.] The Council of State reiterates that, in the absence of a timely appeal of the demolition order, the appeal against the provision of free acquisition to the municipal assets of the illegal building and of the area subject to illegal construction intervention is inadmissible. The demolition order is immediately harmful and, therefore, must be challenged by the person responsible for the abuse; on the other hand, the free acquisition is an act consequential to the ascertainment of the non-compliance with the restoration of the state of the places and, as such, cannot be contested independently. This reconstruction does not change for the owner who - although not directly responsible for the crime - once he became aware of it, did not work to restore the violated legality.
