Abstract
[Autom. eng. transl.] Given a general framework of the case of unauthorized access to a computer or telematic system referred to in art. 615-ter of the Criminal Code and the main jurisprudential and doctrinal disputes that have affected it, the contribution aims to examine and comment on the reformulation of the rule suggested by the VII AIPDP Working Group as part of the proposed reform of crimes against the person. In conclusion, the evolution of the phenomenology of unauthorized access stimulates a reflection on the identification of the protected interest and on the modulation of the sanctioning response in light of the principle of proportion.
