Abstract

[Autom. eng. transl.] The essay examines the remedies available to the contractor victim of the abuse of economic dependence achieved through the conclusion of a null agreement. First of all, the rebalancing of the relationship is achieved through the necessarily partial invalidity of the contract and the compensation for the damage deriving from the incorrect conduct of the author of the abuse. However, in the event that the nullity, concerning precisely the services covered by the contract, cannot be limited to only a part of it, the repetition of what may have been performed, to an extent equivalent to the market value, will allow the weak contractor to obtain an adjustment of the corresponding capital allocations of the exchange.
