Abstract

[Autom. eng. transl.] The essay examines the new case of 'illicit intermediation and exploitation of labor' (Article 603-bis of the Italian Criminal Code), framing it in a broader 'stadial' system of protection: the crime in question seems to be in an intermediate position between administrative or contravening offenses and the most serious crimes for the protection of individual freedom (to which the former is subsidiary). The critical analysis focuses in particular on the concepts of 'taking advantage of the state of need' and of 'exploitation', as well as on the relevant evidence indices. On the political-criminal level, the reflection focuses on the opportunity, for the purpose of effectively contrasting the phenomenon of 'caporalato', the effective control of the pipelines prodromal to it.
