Abstract
[Autom. eng. transl.] The monograph constitutes the translation, by Maria Lucia Karam, into Portuguese - integrated and updated by the writer with respect to the Italian text - of the second edition of the volume "The Church and the problem of punishment. On the response to the negative as a juridical and theological challenge" (L. Eusebi, Scholé -Morcelliana, Brescia 2022).
The text includes an extensive first part whose object is the clarification of the biblical and theological approach, on the basis of an extensive bibliography on the subject and the comparison with the contemporary penal debate, to the topic of punishment: an approach aimed at contesting the practicability of religious references in order to justify retributive conceptions of justice and to motivate how those references rather orient towards conceptions of restorative justice.
In the second part, the volume offers a critical examination of the treatment of the penal problem in the Catechism of the Catholic Church, of the recent canonical legislation on criminal matters and of the penal provisions in force in the Vatican City State.
It is conclusively highlighted how the entire matter takes on importance well beyond the confines of the penal system, making it urgent to innovate the concept of justice operating in intersubjective and international relationships, in order to guarantee a peaceful future.
