Abstract
[Autom. eng. transl.] Intervening to interpret point 31 of Annex I of Directive 2005/29 / EC, concerning unfair commercial business practices vis-à-vis consumers in the internal market, the European Court of Justice notes how the messages about the winning of prizes for which obtaining the winner must bear a cost, albeit minimal, violate the prohibition of unfair commercial practices. The occasion also offers an opportunity to analyze how the case in question, implemented in art. 26, lett. h) Cond. Cons., although formally included in the list of commercial practices in any case aggressive, should more correctly be traced back to the type of deceptive practices, there being a deception to the detriment of the consumer.
